Jeffrey Alan Kovl, 37, of Van Buren Township was charged with reckless use of a gun and possessing a gun while intoxicated on June 16 in Van Buren Township. He was arraigned on July 10 at 34th District Court and took a plea deal.
He pled guilty to reckless use of a gun and the charge of possessing a gun while intoxicated was dismissed on a motion of the prosecuting attorney.
Chief Judge Brian A. Oakley sentenced him to 18 months of probation and a delayed sentence. The charge would be dismissed upon payment of the fees and no further violations. He received credit for four days served in jail, so Judge Oakley levied no fees.
His defense attorney Jeff Bowdich said his client was in the backyard and had fired into the ground. He lives on Robson Road and was 100 yards away from any residences.
“He considered it rural,” Bowdich said. “He just bought a rifle and shot into the ground.”
Kovl told Judge Oakley he has worked at Roush for 7 years and is a family man with children. He said he made a mistake by scaring his neighbors. He said he shot into the ground four times.
Judge Oakley said he probably wouldn’t have been charged if he was not intoxicated at the time and Bowdich said the gentleman his client was with was intoxicated, but his client was not. He said it took four days for them to find out his charges.
Bowdich said police did not test his client’s sobriety but reported his eyes looked red. He was not intoxicated, Bowdich said.
