Brian Robert Bostain, 33, of Van Buren Township, was present via video on June 1, 2022 from the Wayne County Jail where he was being held on $250,000/10% bond on three counts of criminal sexual conduct with a victim under age 13 and one count of using a computer to commit a crime in Van Buren Township on May 22, 2021. His assigned defense attorney needed more discovery, including the Kids’ Talk report, and so Judge Martin adjourned the probable cause conference to June 8.
Defense attorney Lauren Anderson said she needed electronic discovery and Kids’ Talk and so the probable cause conference was adjourned to June 15 and then to June 29 when she still didn’t have all the discovery. He remained in the Wayne County Jail but was inadvertently brought to the courthouse by the Wayne County Sheriff’s department for the June 15 video conference. On June 29, his live preliminary exam was set for July 19. But he waived the exam and was bound over to circuit court for an arraignment on the information on July 26. He then was referred to pretrial services for a bond review and an Aug. 11 motion hearing was set. Then the judge signed orders for a competency evaluation and a criminal responsibility evaluation. The next court date was set for Nov. 10 and then reset to Feb. 10, 2023. That date was canceled and the calendar conference was set March 24 and reset for March 29. Then another competency evaluation was ordered.
On Jan. 20, 2023, Judge Martin arraigned him on four new charges of first-degree criminal sexual conduct on someone under the age of 13 and one more charge of second-degree criminal sexual conduct, along with five added charges of CSC-2 and two charges of aggravated indecent exposure, a total of 12, which happened between Nov. 6, 2012 and Nov. 6, 2016 in Romulus.
A bond of $20,000/10% was set and a GPS tether if released from custody. Also he must not have contact with the victims. A probable cause conference was set for Feb. 1 and then adjourned to Feb. 15.
At that time his live preliminary exam was set for Feb. 24. At that date he waived his exam and was bound over by Judge Martin to a March 2 arraignment on the information on the new charges at circuit court. A calendar conference was set for March 24 and reset for March 29. At that time a competency evaluation was set and a competency hearing set for June 29 and then reset to July 24.
Joshua Royal Blair
Joshua Royal Blair, 34, of Sumpter Township, is charged with possession of weapon by a felon, two counts of felony firearm, possession of ammunition by a felon, and carrying a concealed weapon on Aug. 9 in Sumpter Township.
He was arraigned Aug. 11, and his probable cause conference was Aug. 24. Another probable cause conference was scheduled for Sept. 14 and a live preliminary exam for Oct. 26.
At that time, the exam was held before Judge Oakley, with the first witness being Sumpter Officer Gino Criscenti who testified he was on patrol when he pulled over a vehicle which had gone through an intersection with a plate that had been expired for seven months. The driver did not have a driver’s license and a check in LEIN revealed it had been suspended and there were other warrants.
Officer Criscenti testified that Officer Rodriguez came to assist and found a handgun in the center console of the car. He testified Sgt. Steffani also came to assist and Blair denied owning the gun. Officer Rodriguez testified he found a Smith & Wesson handgun with 7 mm rounds, but there was no round in the chamber.
Judge Oakley bound Blair over to circuit court for an arraignment on the information on Nov. 9. The bond of $2,500/10% which had been posted was continued. A final conference was set for Jan. 6. At that time, he pled guilty to carrying a concealed weapon and all the other charges were dropped. On March 3 he was fined $798 and sentenced to three years of probation and 120 hours of community service.
David Rhys Bragalone II
David Rhys Bragalone II, 34, of Belleville, was video arraigned on a bench warrant on April 28, 2022 by Magistrate Al Hindman. Bragalone is charged with carrying a concealed weapon and operating while intoxicated on July 17, 2021 in Sumpter Township.
The charges were filed on April 22, 2022 and a warrant entered into LEIN on April 27. On April 27, James Makowski filed as Bragalone’s retained attorney and stated the defendant would turn himself in to Sumpter/Huron the next day and he did. His personal bond is $5,000 and his probable cause conference was set for May 11. Then it was adjourned until June 1.
On June 1, he waived his preliminary exam and was bound over to circuit court for a June 15 arraignment on the information. A calendar conference was set for June 23 and a final conference for Aug. 2 and then continued to Sept. 16.
On Sept. 16, he pled guilty to operating while intoxicated and a new charge of buying a weapon without a permit and the charge of carrying a concealed weapon was dismissed. He was sentenced to probation by Circuit Court Judge Margaret Van Houten.
Jacob Lee Hixson
Jacob Lee Hixson, 28, of Van Buren Township was charged with civil infraction for registration/plate and no insurance on April 4 in the City of Belleville. The charges were dismissed on May 4 by Judge Oakley who was told the prosecution wished to dismiss both counts since the situation had been rectified. Judge Oakley reminded Hixson he still owed $822 to the court from other cases in Van Buren Township.
Hezekiah Hudson
Hezekiah Hudson, 21, of Sumpter Township was charged with fleeing a police officer and driving while license suspended on Sept. 17, 2021 in the city of Belleville. His probable cause conference was May 4, 2022 and was adjourned until May 18. He also is charged with reckless use of firearms on July 18, 2021 in Van Buren Township. His remote pretrial on that charge also was held May 4, 2022 and also was adjourned until May 18 so the two cases can stay together. A remote pretrial on another charge, malicious destruction of property-VBPD on July 31, 2021 was scheduled for May 5, but he failed to appear and a warrant was put out for his arrest.
On May 18 he was present for his probable cause and remote pretrial and they were adjourned until June 1 for discovery since his attorney needs video of the fleeing and eluding charge. The warrant on his malicious destruction of property charge was removed from LEIN and his remote pretrial set for June 16.
On June 1, his live preliminary exam on the felony was set for July 13 and the misdemeanor trial will go at the same time.
On July 13, the fleeing and eluding and driving while license suspended charges from Belleville were dismissed by Judge Martin when the police officer necessary for prosecution was not present.
The reckless use of a gun charge was reduced to brandishing a weapon (handgun) in Van Buren Township on July 18, 2021, with a fine.
The malicious destruction of property charge was set for a show cause/pretrial on Aug. 4 and he failed to appear for this court date. On Aug. 9 a bench warrant was issued. On Sept. 12, he called the court and requested a new court date and that the warrant be lifted. He was told he’d have to come in with cash bond and he said he was on his way. He needed the warrant lifted for probation in Court 14A. On Nov. 21, he came in and paid the bond and a show-cause hearing was set for Dec. 1. The warrant was recalled. On Dec. 1 his pretrial was set for Dec. 15. The pretrial was adjourned for discovery until Jan. 19 and then the final pretrial was set for Feb. 2. The complainant must appear. On Feb. 2, Hudson failed to appear so a bench warrant for his arrest was signed.
On Feb. 28, 2023 a remote show-cause/pretrial hearing on the bond was set for March 16 and then a jury trial was requested. The case was reviewed on March 31. A jury trial was set for June 23 but on June 1 he pled guilty and was fined $1,110.
Daveion Armani Copeland
Daveion Armani Copeland, 18, of Ypsilanti, was arraigned May 9, 2022 by Judge Oakley on a May 3 bench warrant for receiving and concealing a motor vehicle and unlawful driving away of an auto on Aug. 9, 2021 in Van Buren Township.
Copeland was in custody at Van Buren Township Police lockup when video arraigned. A probable cause conference was set for May 18 before Judge Green, and then a live exam was set for May 25, 2022. Personal bond was set at $1,000.
On May 25, Assistant Wayne County Prosecutor Bryn Bailey said no witnesses had been called and none sent, so defense attorney Sofia Nelson made a motion to dismiss and Judge Green dismissed the charges. Judge Green said these charges could be refiled.
