John George Phillips, 51, of Fenton was bound over to circuit court for a March 11 arraignment on the information after a preliminary exam on Feb. 26. He is free on $10,000 personal recognizance bond.
Phillips is charged with obtaining by fraud a controlled substance (attempt to conspire/solicit) on Aug. 3 at the CVS pharmacy at 144 Main St. in downtown Belleville.
The preliminary exam took place in 34th District Court Judge David Parrott’s courtroom with visiting Judge Terrence Bronson presiding.
There were two witnesses brought by Assistant Wayne County Prosecutor Holland Roper.
The first witness testified that a prescription had been called in under this name to CVS in Plymouth and they called him. He said nobody had permission to pick this up for him and this was not his prescription. Somebody attempted to pick it up at the CVS in Belleville.
He said a Belleville officer called him and told him they had arrested someone.
Belleville Police Officer Sara Dzagulones was the second witness. She said she was dispatched after the pharmacy called police about a suspicious prescription.
Officer Dzagulones said she took her statement and investigated. She said she called the victim and spoke to him at length about what prescriptions he uses. She said she called the doctor on the prescription and he, apparently, no longer is in practice.
She identified defendant Phillips as the one who picked up the prescription. She said she asked him about the prescription and he said somebody sent him to pick it up.
Judge Bronson bound Phillips over to the Frank Murphy Hall of Justice.
Defense attorney was Jeffrey Knoche, who was appointed by the court.
Charles Wooten
Charles Wooten, 25, of Van Buren Township, was scheduled for a preliminary exam on Feb. 26 and Judge Bronson agreed to adjourn that until March 18.
Wooten is charged with assault with a dangerous weapon (felonious assault) on March 24, 2019 in Van Buren as well as a misdemeanor count of malicious destruction of property between $200 and $1,000.
He is free on $5,000 personal recognizance bond. His court-appointed attorney is Jeffrey Knoche and the Assistant Wayne County Prosecutor is Lori Mireles-Smith.
