Nelson S. Po of Sumpter Township filed a civil suit against Sumpter Township Trustee Donald Paul Swinson on Oct. 26 alleging an “Abuse of Process” in Po’s prosecution for disturbing business at Swinson’s place of employment on Oct. 29, 2015.
Po’s arraignment on that charge was held Nov. 30, 2016 and the jury trial wasn’t held until Nov. 3, 2017.
A 34th District Court jury took about 30 minutes to acquit Po of the charge.
Po said he paid or owes about $20,000 to his attorney in legal fees.
Also, Po alleges, as a result of Swinson’s abuse of legal process, he has suffered loss of the $20,000 in unnecessary legal fees, inconvenience, mental anguish, pain and suffering and the humiliation of being charged with a crime that he did not commit.
He is asking the court to enter judgment against Swinson in an amount no less than $250,000, not including applicable interest, attorney fees, and other costs.
Po’s attorney Ronald R. Ruark demands a trial by jury on all triable issues.
A status conference on the case has been set for 8 a.m., Jan. 25, 2019, before Judge Edward Ewell, Jr. at the Coleman A. Young Municipal Center, Detroit.
