Richard G. Convertino, attorney for Anthony Karver in his Whistleblower law suit against Van Buren Township, said he was informed that Police Lt. Kenneth Floro received almost a quarter of a million dollars in pay from VBT in 2014.
“That’s completely outrageous given the allegations in our complaint that he has been depriving the citizens of Van Buren Township of his services while getting that pay,” said Convertino on Monday.
Convertino called the amount of Floro’s pay “bloated and unjustifiable.”
The law suit claims Karver was fired as Fire Captain on March 10, 2014 because he reported serious infractions of high-ranking police officer Floro, who was getting paid an additional time-and-a-half as a blended-rate fire fighter for time that, on occasion, it is alleged, he actually spent running personal errands.
Floro was ranked VBT’s highest-paid employee in the salary listing published on the front page of the Feb. 19 Independent. His pay for 2014 included $96,247.31 in police wages, $71,049.40 in fire wages, and $48,282.95 in benefits for total compensation of $215,579.66.
Besides suing the township, Karver also is suing Fire Chief Daniel Besson, Supervisor Linda Combs, Public Safety Director Greg Laurain, and Fire Department Battalion Chief/Fire Marshall David McInally.
Karver, who was hired as a fire fighter in August 1992, worked his way up to full-time captain of the VBT Fire Department and was in charge of the department’s fire, rescue and Emergency Medical Services (EMS) operations. As captain of operations, he reported directly to Fire Chief Besson.
According to the law suit, Karver had successfully completed nearly 100 training courses and certifications since his employment began with the VBT Fire Department, including EMT specialist, advanced command staff – complex incidents, FEMA advanced training, MSP Dive Rescue, certified emergency diver, certified ice rescue diver, certified fire inspector, school bus rescue, incident command, incident response to terrorist bombing, Life Flight and trauma life support.
The law suit said Karver has received numerous accolades and commendations for his work.
The Whistleblower law suit concerns operations of the duty crew. Most of the VBT duty crews are staffed by the paid-per-call fire fighters. Rather than responding to emergencies from wherever they are, the duty crew is a 12-hour shift by two fire fighters from a fire station.
A blended rate is the hourly rate paid to a VBT employee who is employed elsewhere in the township and concurrently is employed by the township as a fire fighter on a duty crew at one of the two fire stations in VBT.
The blended hourly rate applied to a public safety department employee is paid at an overtime rate at time-and-a-half because, in theory, the police department employee has already worked 40 hours or more as a full-time employee of the Public Safety Department in addition to his work on a duty crew.
The suit said the VBT employees who receive this blended hourly rate when they work on a duty crew in the fire department are among the top wage earners in township.
The suit tells how this all started. In 2012, Ken Floro held the dual positions of part-time Fire Lieutenant with the VBT Fire Department and full-time Police Lieutenant with the VBT Police Department. Floro received the blended rate of $48.47 per hour when on a duty crew working alongside regular fire fighters who get $18.40 per hour.
In October 2013, Floro was promoted to Captain in the VBT Fire Department and became a lieutenant in charge of the Detective Bureau at the VBT Public Safety Department. In 2013, Captain Floro was transferred to the Fire Operations Division and reported directly to Karver. He was below Karver in the fire department chain of command.
The suit says Karver was duty-bound and procedurally obligated to report violations of law, potential violations of law, and improprieties or suspected violations of law.
In November and December of 2012, Karver was made aware by fire fighters working with Floro that Floro had abandoned his duty crew partner and left the fire station while working duty crew on several occasions without authorization from a supervisor and without giving notice to his duty crew partner.
In December 2012, Karver said he personally observed Floro driving his personal vehicle while he was working duty crew shifts.
When Karver asked him why he was gone from the station without authorization in his personal vehicle, Floro told Karver, who was his supervisor at the time, that he “was out running [personal] errands.”
Karver said he explained to Floro that this was unacceptable practice during shift hours.
In December 2012, Karver informed Fire Chief Besson that Karver was made aware that Floro had repeatedly left the fire station while working duty crew to attend to personal matters in his personal vehicle causing “delayed response times to emergency runs.”
The suit says, “despite being caught, confronted and counseled by his direct supervisor,” Floro continued to leave the fire station while on duty crew shift endangering his fellow fire fighters who would be forced to answer emergency calls alone and the residents of VBT who may have only one of two assigned responders to a medical emergency.
Karver informed Besson in writing that a review of the Station 1 video showed that on one day alone, Floro left the station without authorization, nine times, for a total of 5 hours and 16 minutes.
In November 2013, Karver said he was asked by Besson to meet with Public Safety Director Laurain and Karver asked Besson if he was in trouble and was told by Besson, “No, absolutely not. You’re not in any trouble.”
When Karver met with Laurain in Laurain’s office, Laurain asked him about the status of the Fire Inspector II test. Karver told Laurain that the Fire Inspector II test was the most difficult test he had ever taken and even though he had failed the test Karver was going to retake the exam.
Karver said Laurain told him that his previous test results were not an issue of concern and he “should not worry about it” and that Laurain and the department “would get me through the test.”
The lawsuit states at no time was Karver told he must pass the Fire Inspector II exam by a certain date or that if he failed the next exam he would be terminated.
In late 2013, Karver said he again received numerous complaints about Floro continuing to absent himself from his duty station during his shift without authorization. About Dec. 15, 2013 Karver sent an email to Besson again informing the fire chief that Floro has left shift on multiple occasions to attend to personal matters leaving junior-level fire fighters alone during shift hours.
Karver also said fire fighters who provided information about Floro feared retaliation. Karver said one blended-rate employee feared his statement implicating Floro would “come back to bite me at VBPD.”
On Jan. 21, 2014, Besson emailed Karver that his life had been busy around the holidays and he apologized for the delay in responding. He said he needed more information to move forward on this and carbon-copied Laurain on his email.
On Feb. 21, 2014, Karver transmitted a “high priority” email to Laurain and Besson in response to the Jan. 21, 2014 email by Besson. Karver detailed additional information and concerns regarding Floro’s “continued and serious dereliction of duty” while working on a duty crew at the fire department.
On Feb. 25, 2014, Karver received a notice from The National Fire Protection Association (NFPA) that he failed the Fire Inspector II exam.
About Feb. 27, 2014, Karver copied and provided several statements by employees of the fire department that detailed instances of Floro leaving his duty station without authorization for extended periods of time, all while being compensated by VBT at the high blended hourly rate.
The law suit states that on March 3, 2014, Besson came to Station 1 to meet with Karver. Karver said Besson was angry and irately accused Karver of notifying the VBT Board members about the inquiry related to Floro’s dereliction of duty. Karver denied he had provided information about the investigation to board members and told Besson he did not know who might have disclosed information regarding the investigation.
Karver said only he and Besson had the employees’ statements that confirmed Floro’s absences from his duty station.
During the March 3, 2014 meeting with Besson, Karver informed Besson that if Laurain and Besson continued to allow Floro to leave the fire station without authorization while on duty crew for personal business, Karver would then feel constrained to notify and inform members of the township board of the issue, as he had done in the past on other matters concerning wrongdoing.
The law suit states that directly following the meeting on March 3, 2014, Besson sent Karver a text message instructing Karver to “keep this between us”.
On March 6, 2014, Besson sent an email to Marty Meyers of the NFPA and copied Karver. The subject was: “Upcoming Fire Inspector II Examination”.
Besson wrote: “Marty, Would you mind providing me with the upcoming dates for any NFPA Fire Inspector II examinations? Fire Inspector Karver needs to get enrolled in one. We need the examination retake price too if you can include that. Thanks! Dan.”
The law suit states “on March 6, 2014, Defendant Besson was not contemplating terminating or even disciplining Plaintiff [Karver] for failing the previous Fire Inspector II examination,” but instead wanted to enroll Karver and asked about the fees because VBT was going to pay for the “retake.”
On March 10, 2014, Karver was contacted by his union representative, Fire Fighter and Police Sgt. Mark Abdilla, who told Karver that he was ordered to the township supervisor’s office about an unknown matter and they went right over.
Karver and Abdilla met with Supervisor Combs, Laurain, Besson, and the VBT Human Resources person and Laurain informed Karver he was fired because he had failed the Fire Inspector II exam. Laurain ordered him to turn over his badge and his VBT employee identification, which he did. Karver was then escorted from the building by the VBT Police.
Karver’s attorney Convertino, a former federal prosecutor, said the Whistleblower Protection Act protects an individual who reports or is about to report a suspected violation of law to a public body. A law enforcement agency or any member of a law enforcement agency is a “public body” within the meaning of the Whistleblower Act, he said.
Carlito H. Young and Stephanie Simon Morita of Johnson, Rosati, Schultz & Joppich are the defense attorneys for the township.
The case has been wending its way through the court system since it was filed on June 11 and now may be heading into the final months. A jury trial has been demanded by Karver, but no trial date has been set.
In the law suit Karver asks to be reinstated in his position as Captain without loss of seniority, with back pay and a monetary award.
On Monday, Circuit Court Judge David Allen signed an order denying the township attorneys’ motion for a Stay of Proceedings and a Motion to Adjourn. The township attorneys indicated they will be filing an appeal of Judge Allen’s earlier denial of a Motion to Dismiss the case and wanted to put the main case on hold until the appeal was decided, which could take some time.
But, also on Monday, Judge Allen did adjourn the Case Evaluation from March 17 to sometime in May. Discovery Cut-off also was extended to April 30.
Karver has been going through the arbitration procedure over his firing and the final results are expected to be released shortly.
Known for being outspoken, Fire Captain Karver also had filed a complaint on April 23, 2012 concerning then Fire Chief Darwin Loyer’s actions at an April 18, 2012 structure fire.
Loyer subsequently was fired and Besson took over his job as fire chief. Loyer then sued the township in his own Whistleblower case and got $75,000 in a settlement.
On Monday, Van Buren Township’s defense attorney Carlito Young was not available for comment on Karver’s Whistleblower case because he was out of the office at a seminar.
VBT Supervisor Linda Combs also was out of her office on Monday for a medical procedure, but her standard procedure has been not to discuss pending litigation.
Last summer, when the law suit was pending, Karver was advised by his attorney Convertino not to talk to the press.
The law suit is #14-007522-CZ, a public document on file in the Wayne County Clerk’s office.

The township board needs to have the Michigan State Police investigate. This is criminal and prosecution should be sought. The township board needs to act immediately if they wish to save one crumb of credibility. Anything less than that amounts to a cover-up. The township should also seem to recoup the cost of all those stolen wages.
Cut the fat and get rid of the double dippers. I am starting to wonder who is in charge at the township and what kind of Ponzi scheme allows senior members to get away with this. Are other employees offered this entitlement to run personal errands at an exorbitant expense to the taxpayers? Maybe we should look at hiring new people to fill the gaps.
All I can say is, WOW! When is all this craziness going to stop? How many law suits have to be filed and some awarded when they never should have been. How can VBT budget continue to take these hits? Greed is the bottom line here. All of the high paid officers are only in this for the money! These positions use to be about honor, but the almighty dollar has taken over. When will the citizens demand that the board is seated with honest candidates upholding rules and making township employees accountable? In fact I wonder if a previous chief that was fired was fired for bringing this to the attention of his superiors? He left without suing, why? Maybe he wanted to save the budget which he already knew was compromised by blended rate pay? The old public safety directorate be gone but he trained these high paying officers well. He taught them how to cheat the system, step on whoever you need to to get what you want, never mind the cost to the taxpayers! VBT had to hire Besson as no one else wanted this job. They can’t even pull from outside anymore because VBT fire chief is now known as a nothing job unless but being a yes man. Besson was turned down any times for this Job but now they have to take who they can get. Come on citizens need to have all the corruption brought out in the light before the next election. For all of you that will start whining … “But these jobs are dangerous, they are away from their families on holidays and put in numerous hours”….. Stop while your ahead. They picked this career and while it is a noble one their pay and stupid lawsuits are not justifiable. Quit whining, do your jobs and live within the means of an honest pay instead of worrying about the almighty dollar or step down and let the public have what they pay for and deserve!!!
This is not the first year that we have seen the wages through the roof, this must be at least the 5th year? Shame on the township board for not taking action and letting these things get out of control. There is no excuse, time to cleanse these people who think the law doesn’t apply to them. It seems like every month the township is being sued over things that could have been handled internally. Do the right thing Linda Combs – step down. Impeach yourself!
If this were a business, these problems would have been solved already. How can we pay one person working full time hours at a first job, a second salary that is more than the other fire fighters that only have the one job? We need a few good men to lead the fire stations and hire some more part time guys or here’s a thought, pay for some full time guys with the salaries from all the cops that are sleeping off their day shifts at the station.
Laurain is very uneducated and it shows, he can’t even balance a budget. Oh, the budget he continually steals from for his own personal use. Someone should look into that as well…

I have a family member who is a FF with this department and to the poster above who said that ALL the “blended rate” guys are doing it for the money is not accurate. You have no clue, as that is a blanket statement with no merit. Just take a look at those officers who actually make trainings that are paid on a real FF wage. That will tell the story.
The problem here is that you have people in high ranking positions with either no experience or no education (or worse, both) – and this is where bad decisions come from. Let’s start at the top of the food chain, Linda Combs. She ran for Supervisor because she had a vendetta out against the previous Supervisor. Since she has been in office, she has fallen asleep at meetings (perhaps she slept during the budget discussions ??). Did you fall asleep when instances like this article came across your desk?
Then you have the Public Safety Director who has no formal education and FBI school doesn’t count. It’s apparent he needs Business Administration courses emphasizing Human Resources. This is an example of a position handed to someone within a department for ONLY years of service, just because he has been there for 2 decades doesn’t make him a fit for this position.
The current Fire Chief has a formal education but not enough experience in an administrative leadership role to be handed Chief position. If you look at the antics on social media, this individual lacks maturity a role like this desperately needs. Food for thought.
I agree Linda did have a vendetta against the previous supervisor and so did another current full-time elected official. This official even encouraged township employees to work against him.

Chief Besson or if we want to get technical it’s deputy chief, was turned down for the very reason the above poster mentioned which was immaturity and lacked leadership skills. It’s pretty quiet on this post which is unusual for the wives of these officers, supporters or friends. Might it be since Karver did what a few other chiefs did out of the public eye, meaning to their board members, they know lauraine, floro and Besson are finished? It would be great for the tax paying residents to also see the frivilous spending habits of “current” management, i.e. the Fire Chief. The residents would like justification on the purchase of a 2nd vehicle for use in the “warmer months” to drive around town. He likes to be seen in this black Charger, a former police vehicle. Why does a Fire Chief need a newly decaled with fire equipment and stickers (which we as tax payers money was spent on) Charger? Does he get to the fire scene faster? Did you run a cost analysis on gas spenditure? Does it hold more equipment? Do you use it for personal use and personal errands? Is this why the Chief covered up the allegations from Karver and fired him to keep his mouth shut? Let us all dig into more detail. I will be asking for all budget expenditures from our township the last 2 years and run my own analysis.
Does anyone know if an investigation is being done or these employees were dismissed from duties? I am a struggling single mom and it makes me upset to see People taking advantage of the public Tax dollars.
Nothing will be done. It would make the township board members look bad and cause the public to become reluctant to trust PD or FD and that is a factual problem that doesn’t need to happen. If the board would just come out and say hey we have documentation that takes this all the way back to king/champagne era and we are sorry we let it continue and we will fix it and weed out the bad ones left so you can have PD and FD to be proud of. I think the township would grow stronger as a whole not just the officials.

The public safety millage will not pass. There is a new committee starting up for citizens who demand transparency within THEIR police and fire departments. Details will be made public soon and will be publicized in a few different places. We have to take back our township or things will never change people. Greg will retire soon because he can’t afford to be fired – which is iminent. He has no respect from his guys and he knows it. Former Director Gerry even stopped taking his calls because he has given him to much advice already. So remember when you vote for your next Supervisor and Treasurer. If the board does the right thing and gets MSP involved you will see improvment but you probably won’t see that because they are involved in the budget cover ups. Although never a fan of Gerry and his blended rate program, aka” Gerry’s Boys”, I like the idea of taking back the township.
Back before the supervisor disbanded the Public Safety Committee, there was an avenue for the public to speak privately or publicly about safety issues.
Now, once a year the public is invited to coffee where they can lick Laurain’s boots pat him on the back, and polish the eagle on his honor guard staff.
That was a little harsh. The point is, respect and trust are earned. Laurain hasn’t shown that he even cares about public safety, response times, or PS moral.
Besson is just as bad, ignoring documented complaints by supervising personnel and firing them for speaking up.
Supervisor Combs, when she’s awake, is oblivious. She reads a prepared “ales gut”statement that new policies were supposed to be in place to address the greedy skimming of the budget by the blended rate employees. All it was, was a feel good statement with no data to back it up. In fact, FOIAd data proved as much.
Unless the Board wakes up and demands answers, the Visteon bonds debacle, failed public safety millage renewal, using the township as a dumping ground for fracking waste and the DDAs spending spree will usher in an emergency manager.

I don’t care if Besson is Christian or not, what I do know is he is in over his head and pretty much does whatever Laurain says (or whoever is in charge at the moment). He has no backbone whatsoever, which is why he will be fired along side Greg. If you ask any of the surrounding city Fire Chiefs (Respective) you will find they all have the same opion of Dan. Not a great leader. He is mediocre at best. Look, this ia a guy who stated back in 2012 – “Right now we’re on emergency status … fixing the trucks to work, saving money for the end of the year to buy 12 needed sets of turnout gear,” Besson said. ”
The guy wasted money on his own personel benefit to purchase a 2nd chief vehicle. A Charger. Why does he need 2 vehicles? Take his kids to school in the morning like the other accused? Please peel back the layers and get MSP involved. Do the right thing “board of trustees” or you’ll be embarrassed when further allegations come out and you guys sit there with your thumbs up your rumps.
Can citizens request for the MSP to get involved? Something has to be done! We have been considered a politically corrupt township for many many years and I’m talking 20 plus yrs.
whenwillitstop, Sir, I would appreciate not being included in your comment. I worked 65-70 hours weekly serving our residents. Check the ’10, ’11, and ’12 budget DECREASES and General Fund Balance INCREASES. Very good results. Also, I NEVER was sleeping during important meetings. My activity included reducing the work force by 16 FT employees with no decrease in services. Every conference or Educational meeting paid for was attended. I took 4 days off in 4 years, and two were for family member sickness. Very sick! My hours were usually from 6:30AM until the work was finished, and then evening meetings. You are correct in many areas, and I appreciate your postings. Residents having knowledge of local government operations is critical to improve the quality of tax expenditures in an efficient and effective manner. Thank You, Former VBT Supervisor Paul D. White.
I agree with the above post – Linda Combs please step down as Supervisor and relinquish your duties. You were mad at Paul White and now you are single handedly making our township a common joke between neighboring communities. I embarrassed when reputable council members remark on you falling asleep during meetings. Who does that?
I agree with who cares if he’s a Christian I just stated that because of some comments I have seen floating around about good ole Christian Dan. This all started under Cindy King if you ask me there should be investigations that go all the way back to good old Gerry and Cindy!!! Back when Besson did was not yet chief, they told him they did not feel he was mature enough and lacked leadership. With that being said I guess it just came down to they needed to fill the position. Former PD is right he is not thought of very highly.
Everyone is missing the big picture. Safety is a major concern and it seems as though this isn’t being addressed by the township or the chief or director. It’s not ok to leave a probationary firefighter by themselves for length of time. That’s negligent and unfair to everyone involved. It’s not ok.
The plaintiff has one heck of an attorney and very well respected in our business. Definitely a suit that I wouldn’t want to argue against.

This township is backwards. This story is like me saying I better not report a crime in the community or I may get retaliation in some way. Same slimy cop who not only screws up inside of the department but doesn’t do his job outside of the department either. Still waiting on a follow up to the burglary 3 years ago at my mothers home. No wonder cops have a bad rap, they think they are above the law.

Is the video tape available where this officer was gone over 5 hours of his shift?
Ya right, that tape was probably destroyed. Or they will tell you they only keep the tapes for so many days. Of course any logical agency (fire chief) who had experience in the position would make sure to keep tape as evidence for future. In cases like this where it will come back to bite you since it was reported.
And according to the letter in todays paper, he is still making that money.
